Terms of Service

1. Acceptance
These Terms govern your use of NicheBreakout, a product operated by NMajor Studios LLC. By accessing or using NicheBreakout, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. The Service
NicheBreakout is a research tool that surfaces young YouTube channels and public-format signals based on public YouTube metadata and derived calculations. The service is provided for research and informational purposes only. Scores, rankings, cohorts, and examples are not business, financial, legal, or professional advice.
3. Accounts
You are responsible for keeping your account access secure and for all activity under your account. You must provide accurate account information and may not share, resell, or transfer your account without our permission.
4. YouTube API Services
NicheBreakout uses YouTube API Services. By using NicheBreakout, you also agree to the YouTube Terms of Service. Google's Privacy Policy is available online.
NicheBreakout is not affiliated with, endorsed by, or sponsored by YouTube or Google. YouTube data may change, be delayed, become unavailable, or be removed from the YouTube API. We may update, remove, or stop displaying YouTube-derived data to comply with YouTube API Services requirements.
5. Subscriptions, Billing, and Refunds
Paid access is sold through Polar as merchant of record. Prices, billing intervals, and included features are shown at checkout. Unless stated otherwise at checkout, subscriptions renew until canceled. You can cancel future renewals through the account/billing flow when available.
Refunds are available within 7 days of purchase if you have not materially used paid exports or bulk data access. Taxes, chargebacks, payment failures, and refund processing may be handled by Polar under its checkout terms.
6. Acceptable Use
You may not misuse NicheBreakout, including by scraping or bulk-extracting the service outside provided exports; bypassing access controls; reselling raw data; harassing, impersonating, or targeting creators; violating YouTube's terms; misrepresenting public metadata as private YouTube Analytics data; or interfering with the service, providers, or integrations.
7. Data and Accuracy
NicheBreakout depends on public third-party API data and derived calculations. We do not guarantee that data is complete, current, error-free, or predictive of channel success. You are responsible for your own evaluation and decisions.
8. Ownership
NicheBreakout, including its software, design, methodology, branding, and original content, is owned by us or our licensors. YouTube channel names, videos, thumbnails, avatars, banners, and related public metadata belong to their respective owners and are displayed from public sources.
9. Third-Party Services
The service depends on third-party providers, including Cloudflare, Google/YouTube, Polar, Buttondown, AhaSend, Crisp, and self-hosted Rybbit analytics. Their services may have separate terms and privacy policies. We are not responsible for third-party outages, policy changes, or data availability.
10. Termination
We may suspend or terminate access if you violate these Terms, fail to pay, create security or legal risk, abuse integrations, or use the service unlawfully. You may stop using the service or cancel your subscription at any time.
11. Disclaimers and Liability
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy. To the maximum extent permitted by law, our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid to NicheBreakout in the 3 months before the claim or USD $100.
12. Governing Law
These Terms are governed by the laws of Wyoming, USA, without regard to conflict-of-law rules, unless applicable consumer protection law requires otherwise.
13. Changes
We may update these Terms. Material changes will be posted on this page and, where appropriate, communicated in-product. Continued use after the effective date means you accept the updated Terms.
